NOTICE: Please review this User Agreement before you begin using the Community. By accessing or using the Community, you confirm that you have read and accept the terms of this User Agreement, including the Community Rules, without any limitations.

If you do not agree with the terms of this User Agreement, do not use the Community.

USER AGREEMENT

Effective as of February 10th, 2026

Period Tracker & Pregnancy and Baby Calendar Limited, a legal entity organized and existing under the laws of SAR Hong Kong, having its principal place of business located at: 2301, Bayfield Building, 99 Hennessy Road, Wanchai, Hong Kong, Business No.: 70409838, and amma affiliates, operating together under the brand “amma” (hereinafter referred to as “AMMA”, “we”),

and a person using the Community (hereinafter referred to as the “User”, “You”), on the other side,

hereinafter collectively referred to as the “Parties”, and individually as a “Party”,

enter into this User Agreement on the following terms (hereinafter, the “Agreement”).

1. TERMS AND DEFINITIONS

1.1.For the purposes of uniform application and interpretation of the provisions of this Agreement, the Parties have agreed on the following meanings of the terms used:

“Prohibited Content” means any information, publication, materials, or conduct that violates applicable laws or regulations or is otherwise unlawful, including, without limitation, information or content that:

• provides instructions on the development, manufacture, acquisition, distribution, or use of illegal drugs, controlled substances, psychotropic substances, their precursors, new or potentially dangerous psychoactive substances, or the cultivation of plants containing controlled substances, including where to obtain any of the foregoing;

• provides instructions on suicide or self-harm, or contains encouragement, promotion, or calls to commit suicide or self-harm;

• violates laws or regulations applicable to gambling or lotteries, including content that promotes, facilitates, organizes, or enables unlawful gambling or lottery activities via the Internet or other communications networks;

• contains offers, promotions, or other facilitation of the sale of alcoholic beverages or alcohol-containing products, including ethyl alcohol, where such sale (including remote, online sale) is restricted or prohibited by applicable law;

• is expressed in an obscene, indecent, or grossly offensive form, or otherwise insults human dignity or public morality, or constitutes unlawful hate speech, harassment, or discriminatory abuse;

• contains calls for violence, mass disorder, public unrest, or extremist or terrorist activity, or promotes or facilitates participation in unlawful public events; disseminates false or misleading information presented as reliable where such dissemination may create a risk of harm to life, health, property, public safety, or the functioning of critical infrastructure or essential services; or provides access to or facilitates access to content that is unlawful under applicable law;

• is aimed at inducing, coercing, grooming, or otherwise involving minors in unlawful acts or in conduct that poses a threat to their life, health, safety, or to the life, health, or safety of others;

• contains child sexual abuse material or any sexual content involving minors, or any announcements or solicitation involving minors in pornographic or sexually explicit performances;

• incites, promotes, or facilitates hatred, violence, or discrimination against individuals or groups on the basis of protected characteristics (including, for example, race, ethnicity, nationality, religion, sex, sexual orientation, gender identity, disability, or other status protected by applicable law).

“Mobile Application” means a mobile application for planning and tracking pregnancy as well as stages of a child’s development, developed and owned by AMMA, which may be identified by its placement in app stores via the following links:

• Google Play (https://play.google.com/store/apps/details?id=ru.mobiledimension.kbr); 

• App Store (https://apps.apple.com/app/id990178211).

“Privacy Policy” means the Personal Data Processing Policy posted at https://amma.family/privacy-policy.

“Personal Data” means any information relating to a directly or indirectly identified or identifiable natural person (the data subject).

“User Content” means any content, including, among other things, text, images, video, audio, comments, reviews, messages, answers, advice, recommendations and other materials that users of the Community, including Experts, upload, publish, transmit, or otherwise provide through the Community.

“Community Rules” means the rules of conduct published in the Community https://amma.family/rules-community, binding on all Users.

“Agreement” means this User Agreement with all amendments and changes.

“Community” means an integrated platform for communication among Users, designed for women and families planning pregnancy, pregnant, or raising young children. The platform is located in a special section (tab) of the Mobile Application and provides users with a supportive, informative, and safe space for interaction, exchange of experience, and support throughout the family-building journey. The Community is also available online on the relevant website to reach a wider audience and help even more women take control of their reproductive health.

1.2.Terms not defined in clause 1.1 may be used in the Agreement. In this case, interpretation of such a term shall be made in accordance with the text of the Agreement. If the text of this Agreement does not provide a clear and unambiguous meaning, the interpretation shall be guided primarily by applicable law, and, to the extent permitted and appropriate, by the meaning commonly used in relevant industry practice and on the Internet. 

10.3.Headings (clauses) of the Agreement are provided for convenience only and do not have literal legal meaning.

2. SUBJECT OF THE AGREEMENT

2.1.The subject of this Agreement is granting the User access to the functionality of the Community.

2.2.This Agreement applies to all functionalities of the Community existing at the time, as well as any subsequent modifications thereof and additional functions (services) introduced in the future.

3. CONCLUSION OF THE AGREEMENT AND COMMENCEMENT OF USE OF THE COMMUNITY

3.1.This text of the Agreement constitutes AMMA’s offer to enter into an agreement with any legally capable natural person who has reached the age permitted under applicable law to accept this Agreement and use the Community on the terms set forth herein. To the extent permitted by applicable law, this Agreement is not intended to create, and shall not be construed as creating, any public contract or mandatory service obligation on AMMA to provide access to the Community to any person on equal terms. 

3.2.Proper acceptance of the offer is entry into the Community. Entry may be performed by going to the Community section in the Mobile Application or on the relevant website after authorization.

3.3.By entering the Community, the User accedes to this Agreement and confirms legal capacity, as well as the fact that, at the time of commencing use of the Community, the User has reached the age permitted by applicable law.

3.4.If you are under 18, your legal representative (parent or guardian) must review and accept the terms of this Agreement, and by entering the Community, you confirm that your parent or guardian has reviewed and accepted this Agreement. We reserve the right, at our discretion, to restrict users under 18 from accessing certain content in the Community.

3.5.In order to be able to publish User Content, the User must create an account by registering in the Community, which requires entering data.

3.6.The information you provide during registration will be processed in accordance with our Privacy Policy. You agree to provide accurate and complete information and to promptly update it after changes.

3.7.If you are a registered user of the Mobile Application, you already have an account. In this case, no additional registration or authorization is required to enter the Community from the Mobile Application; however, when entering the Community via the Mobile Application, you may be asked to provide additional data (for example, such as region (country), nickname in the Community, and the groups in the Community that interest you). Upon entering the Community through the website, you will need to go through authorization to confirm access to your account.

3.8.Unless the User proves otherwise, any actions performed using the User’s account shall be deemed performed by the respective User.

4. LIMITED LICENSE TO THE COMMUNITY

4.1.For the term of the Agreement, AMMA grants the User, free of charge, under a non-exclusive, non-transferable (non-sublicensable) and revocable license, the right to use the Community for its direct functional purpose exclusively for personal non-commercial use (exclusively for personal, family, household and other needs not related to carrying out entrepreneurial activities).

4.2.The User may use the Community on an unlimited number of personal devices.

4.3.The license is granted to the User without the right to transfer under sublicense agreements.

4.4.The license is granted to the User in the territory within which the Community remains available to the User.

4.5.Except for use to the extent and in the ways expressly provided for by this Agreement, the User may not, independently or with involvement of third parties, modify the Community, perform reverse engineering, including, among other things, decompile, disassemble, decrypt, or perform other actions with the object code of the Community aimed at extracting the source code of the Community and (or) obtaining information about the implementation of algorithms used in the Community, create derivative works using the Community, distribute, communicate to the public and provide other access to the Community or its individual elements, as well as perform (permit) other use of the Community without AMMA’s written consent.

4.6.You also agree not to copy, download, display, or use any Community content provided by AMMA or its licensors that is located in the Community for use in any publications, public performances, on websites other than the Community, for any commercial purposes, in connection with products or services not owned by AMMA, or in any other way that may cause consumer confusion, disparage or discredit AMMA and (or) its licensors, weaken the strength of AMMA’s or its licensors’ property, or otherwise infringe AMMA’s or its licensors’ intellectual property rights. You also agree not to unlawfully use (both within and outside the Community) any content published by AMMA or third-party content that appears in the Community.

4.7.All rights, title, and interests in and to the Community not expressly granted in this Agreement remain with AMMA. If you wish to use AMMA’s software, title, trade name, trademark, service mark, logo, domain name and (or) any other designation with AMMA’s visible branding characteristics, or other content owned by AMMA, you must obtain AMMA’s written permission.

4.8.For the avoidance of doubt, AMMA owns all texts, images, photos, audio, video, content, and all other forms of data or communications that AMMA creates and provides in connection with the Community, including, without limitation, visual interfaces, interactive features, graphics, design, compilation of User Content (as defined below in Section 5) and all other elements and components of the Community, excluding User Content (collectively hereinafter, “AMMA Content”). Except as expressly and unambiguously provided herein, we do not grant you any express or implied rights, and all rights in and to the Community and AMMA Content remain with us.

4.9.Any violation of this Agreement immediately and automatically terminates your license to use the Community.

5. LICENSE TO USER CONTENT. CONSENT TO USE AN IMAGE INCLUDED IN USER CONTENT

5.1.The Community allows you to publish or upload content, provide content, and register certain information in the Community (“User Content”). You retain all rights to such User Content that you publish, share, or register in the Community.

5.2.The User grants AMMA a worldwide, royalty-free, non-exclusive license to the content published by you in the Community (including the posts themselves and intellectual property objects included therein), with the right to use it in any ways permitted by applicable law, including, without limitation, the right to reproduce, store, use, distribute, modify, run, copy, publicly perform and display, translate, and create derivative works. The license is granted with the right of assignment and sublicensing. The User represents and warrants that the User has proper rights to use all third-party intellectual property objects published by the User in the Community. The User agrees to settle all claims and to reimburse AMMA and its affiliates, directors, officers, employees, contractors, customers, partners for all losses and expenses, including attorneys’ fees, arising as a result of the User’s failure to comply with the terms described in this Agreement.

5.3.AMMA is entitled to use User Content published in the Community and available to the public for the development of advertising materials and placement of materials both as online advertising and outdoor advertising.

5.4.Consent to use an image. By posting your image (photo, video, other) or the image of another person (including your child or a person for whom you are the legal representative), you give AMMA consent to disclose and use such image. With respect to images of third parties, you represent and warrant that you have obtained the explicit consent of the owner for their disclosure, publication, and granting AMMA the right to use them. You may always revoke such consent by contacting AMMA.

6. USER RIGHTS AND OBLIGATIONS

6.1.The User has the right to access the Community for viewing.

6.2.The User has the right to use all functionality of the Community, including posting or uploading User Content after complying with registration requirements and subject to compliance with this Agreement.

6.3.The User has the right to ask any questions related to the operation of the Community using the details provided in the “Contacts” section.

6.4.The User must duly comply with this Agreement.

6.5.The User may not impersonate other persons, create fake accounts, or transfer access to their account to third parties without AMMA’s consent. When transferring account management to other persons with AMMA’s consent, the User continues to bear full individual responsibility for all publications and other actions performed in the User’s account.

6.6.The User must inform AMMA of loss of access to the account or unauthorized authorization in the Community on the User’s behalf.

6.7.The User agrees to use the Community, including User Content, in a manner that does not violate the rights and legitimate interests of any rights holders, third parties, this Agreement, and applicable law.

6.8.The User must duly comply with the Community Guidelines.

6.9.YOU MUST FOLLOW THE FOLLOWING RESTRICTIONS and you agree that if you commit any of the following acts, you materially breach this Agreement:

• do not publish Prohibited Content;

• do not violate the Community Rules;

• do not violate the rights of third parties, including do not publish messages that violate or infringe the rights of others;

• do not use the Community to engage in any unlawful activity;

• do not use your account for advertising, requesting, or transmitting any commercial advertising without AMMA’s written permission;

• do not publish messages and media of any kind containing expressions or calls for hatred or violence, discriminatory, obscene, or offensive content, including pornography, sexually explicit material, or any material that may entail civil, administrative, criminal or other liability under applicable law and (or) that contradicts this Agreement and the Community Rules;

• do not publish fraudulent or misleading materials; 

• do not publish or otherwise use materials that do not belong to you or for which you do not have rights to publish and use; do not use another person’s intellectual property without permission (including User Content published by other Users) – thereby you will violate copyright, related and other intellectual rights of third parties;

• do not upload any material containing software viruses or any other computer code, files, or programs that are malicious, technically harmful, or intended to interrupt, destroy, or limit the functionality of any computer software, website, or the Community;

• do not collect Community data using automated means and do not attempt to access data without appropriate permission, regardless of whether such automated access or collection is performed while logged into an account or without it;

• do not publish, distribute, or otherwise process in the Community, without consent or other lawful basis, other persons’ Personal Data;

• if another User has published Personal Data in the Community, whether in a text message, photograph (for example, of test results, medical reports) or otherwise, do not save, distribute, or otherwise process it either within the Community or outside it;

• do not publish your own or others’ (including your child’s or another person’s for whom you are the legal representative) Personal Data from special categories requiring enhanced protection, including medical tests, examination results, a doctor’s opinion, health information, biometric data (face photo, fingerprints), information on criminal record, nationality, political views, as well as any other sensitive information that may cause harm.

7. AMMA RIGHTS AND OBLIGATIONS

7.1.AMMA reserves the right, at its discretion, to modify, add, or remove any Community functionality (including the entire Community) without notifying the User and without paying any compensation.

7.2.If you download or use our software, you allow AMMA to download and install software updates where applicable.

7.3.AMMA has the right to transfer its rights and obligations under this Agreement to third parties for the purposes of performance of this Agreement without additional consent of the User.

7.4.AMMA has the right to post information in the Community or otherwise bring it to the attention of Community Users (for example, send PUSH notifications unless the User has disabled PUSH notifications in settings). AMMA has the right to place advertisements in the Community.

7.5.AMMA has the right, without warning, to review, delete, edit, or block User Content that violates this Agreement, the Community Rules, or applicable laws.

7.6.If violations of the Agreement, the Community Rules and (or) applicable law are identified, AMMA has the right to:

• issue a warning/recommendation to correct;

• temporarily restrict access to the Community;

• permanently block the User’s account;

• delete User Content without restoration.

7.7.The User has the right to appeal actions of moderators using the details provided in the “Contacts” section. AMMA will consider the appeal at its discretion; however, moderators’ decisions are final and are not subject to mandatory review.

7.8.In order to improve and increase the stability of the Community, AMMA has the right to collect, store, and process statistical information about the User’s use of the Community. In particular, the User agrees that AMMA will receive and use data on the User’s geolocation from the mobile device.

7.9.AMMA has the right to provide authorization in the Community via third-party services. In such a case, use of the Community is possible only upon acceptance and compliance with the terms of use of the relevant products, and by accepting this Agreement, the User also agrees to comply with such terms when using the Community.

7.10.AMMA has the right to invite you to participate in surveys and social research to improve our services. Participation is voluntary, and you may refuse, which will not affect use of the Community.

8. REPRESENTATIONS OF THE PARTIES

8.1.By accepting this Agreement, the User makes the following representations:

8.1.1.The User has reached the age of 18, has full legal capacity and has the right to enter into these legal relations, or acts as a legal representative (for example, of a minor user).

8.1.2.The User Content published in the Community fully belongs to the User and (or) the User has all necessary rights (copyright, related and other rights) to it, including the right to public distribution, processing and use in the Community.

8.1.3.The User Content does not violate third-party rights, including intellectual property rights, honor, dignity and business reputation, and does not contain Prohibited Content and does not violate the Community Rules.

8.1.4.The User’s use of the Community and provision of User Content does not violate the User’s other obligations to third parties, including existing contracts, confidentiality agreements, or restrictions on disclosure of information.

8.1.5.The Personal Data provided by the User during registration and use of the Community is accurate, up to date and true. The User has given AMMA consent to its processing, acting freely, of their own will and in their own interest, in accordance with the Privacy Policy.

8.1.6.The User will not take measures aimed at causing damage to AMMA, other Community users, mobile operators, rights holders, or other persons.

8.2.AMMA makes the following representations to the User:

8.2.1.AMMA has all necessary rights to provide access to the Community in accordance with the terms of this Agreement.

8.2.2.AMMA will process the User’s Personal Data in accordance with the requirements of applicable Personal Data legislation and the Privacy Policy.

8.2.3.AMMA takes reasonable measures to ensure operability of the Community within its experimental status.

8.2.4.These representations are the only warranties provided by AMMA. AMMA disclaims any other express or implied warranties not stated in this Agreement.

9. USER LIABILITY

9.1.The User bears full responsibility for:

• violation of this Agreement, the Community Rules, and the applicable laws;

• unlawful use of User Content, including infringement of third-party rights;

• any losses caused to AMMA, affiliates, directors, officers, employees, contractors, customers, partners as a result of the User’s actions and (or) omissions, including amounts of imposed fines, claims filed, legal costs and expenses for legal defense;

• accuracy and relevance of the provided Personal Data;

• any content or other information that the User uploads or otherwise communicates to the public (publishes) in the Community or with its help. The User has no right to upload, transmit, or publish content if the User does not have appropriate rights to perform such actions acquired or transferred to the User in accordance with applicable law.

10. LIMITATIONS OF AMMA LIABILITY AND DISCLAIMERS

10.1.No warranties.

10.1.1.The Community is experimental and under development. You understand and agree that:

• development of the Community is not completed, and the Community software may not have undergone a full testing cycle, as a result of which the Community may operate incorrectly, change significantly, and not correspond to the performance or compatibility level of a final product;

• as a beta product, the Community may not be fully functional and may contain errors, software inaccuracies, design defects, or other problems;

• AMMA does not guarantee completeness, accuracy, security, uninterrupted operation, quality, or fitness of the Community for any purposes;

• you will use the Community functionality at your own risk, “as is”, without any warranties, express or implied; AMMA does not promise or guarantee any results from using the Community;

• the Community and its use may lead to unpredictable results, including loss of data or other unpredictable damage or losses to you; and

• AMMA has the right to unilaterally discontinue development of the Community at any time without any obligations or liability to you or third parties.

10.1.2.The User uses the Community at their own risk and bears personal responsibility for possible consequences of using the Community and content published therein. By accepting the terms of this Agreement, you assume all possible risks associated with use of the Community and content published therein, operational errors and inaccuracies in the presented data, and, to the maximum extent permitted by law, release AMMA, its affiliates, employees, contractors, suppliers and licensors from liability for any actual damage, lost profit, or other losses (including non-pecuniary loss) suffered by you or third parties as a result of use or inability to use the Community (including, without limitation, any services, products or information provided through the Community), regardless of whether you were warned of the possibility of such losses or other losses.

10.2.Medical disclaimer.

10.2.1.AMMA is not a licensed medical institution and does not provide medical services, including telemedicine services. AMMA and its employees under no circumstances provide medical services to the User, paid or free of charge, including in the form of consultation, do not give advice on diagnosis and treatment of diseases, as well as taking medications.

10.2.2.Community content, including User Content (including recommendations, comments, advice, answers, and publications by doctors, experts, and other specialists), algorithmic recommendations, and any other information made available in the Community (hereinafter, the “Information”) is provided for general informational purposes only, does not constitute a medical service, and must not be construed as medical advice, a medical consultation, diagnosis, or a prescription. Under no circumstances is the Information intended to replace professional medical consultation, diagnosis, treatment, or management of any disease or condition, and it is not a method of contraception. AMMA states that content uploaded and distributed in the Community is provided for informational purposes only and does not replace consultations with qualified healthcare professionals for diagnosis and treatment. AMMA strongly recommends that Users consult qualified physicians and other relevant specialists before purchasing any goods, services, or works referenced in the Community, including those presented in promotional or advertising materials distributed by AMMA and (or) third parties (with AMMA’s permission).

10.2.3.AMMA does not check, verify, control, or guarantee the accuracy, reliability, safety, or professional qualification of the authors of User Content, including Experts’ recommendations.

10.2.4.We do not provide any express or implied warranties relating to the accuracy, sufficiency, relevance, reliability, individual applicability, availability, or completeness of the information contained in User Content.

10.2.5.AMMA is not a representative of Experts, doctors, medical institutions, as well as individuals who sought medical assistance from them, therefore it cannot be responsible for any financial obligations arising between the former and the latter. Any arrangements between the above-mentioned persons using the Community are bilateral, and AMMA has no relation to them.

10.2.6.AMMA does not recommend the authors’ opinions and may not share the authors’ opinions (including Users, Experts). AMMA does not recommend any doctors, or clinics, or medicines mentioned in the Community, or links posted in the Community.

10.2.7.Since Community Users do not undergo identity verification and, as a result, identifying their identity is technically difficult, AMMA is not responsible for Users, including Experts, actually being the persons they claim to be, and is not liable for possible damage caused to Users or other persons for this reason.

10.2.8.SEEK MEDICAL HELP IMMEDIATELY IF YOU HAVE QUESTIONS OR COMPLAINTS RELATED TO YOUR WELL-BEING OR CONDITION, OR IF YOU FEEL CHANGES IN YOUR BODY. CONSULT A SPECIALIST IN THE RELEVANT FIELD OF MEDICINE BEFORE MAKING ANY DECISIONS OR TAKING ANY ACTIONS THAT MAY AFFECT YOUR HEALTH AND SAFETY OR THE HEALTH OF YOUR FAMILY OR THE FETUS. NEVER IGNORE A SPECIALIST’S ADVICE AND DO NOT CANCEL AN APPOINTMENT BASED ON INFORMATION RECEIVED IN THE COMMUNITY. IF YOU THINK YOU HAVE A MEDICAL EMERGENCY, IMMEDIATELY CALL YOUR LOCAL EMERGENCY NUMBER OR GO TO THE NEAREST OPEN CLINIC OR HOSPITAL.

10.2.9.You release AMMA, its affiliates, directors, officers, employees, contractors, customers, partners from liability for any actual damage, lost profit, or other losses (including non-pecuniary loss) suffered by you or third parties as a result of using the Community and (or) reliance on the information contained therein. This release does not apply to cases of intentional harm to life or health.

10.3.Warning about sensitive content.

10.3.1.The Community is intended for users to discuss topics related to pregnancy planning, motherhood, parenting, and related aspects of health. User Content may contain personal experience, opinions, or discussions that some users may find sensitive, emotionally difficult, or inconsistent with certain individual or public standards. User Content may also contain errors, typos, omissions, and inaccuracies.

10.3.2.If such content causes you discomfort, we recommend refraining from viewing it or from using the Community as a whole. By continuing to use the Community, you acknowledge the presence of potentially sensitive content and fully release us from any liability for it, including emotional harm or other consequences.

10.3.3.By using the Community, you also release us from liability for violation of any ethical or moral standards applicable in your culture, locality, community, or society to sexual education and related materials.

10.4.Disclaimer on use by minors.

10.4.1.The Community is intended for users to communicate on topics related to pregnancy planning, motherhood, parenting, and related aspects of health. Information in the Community is not intended to encourage, promote, or provoke any sexual behavior or activity among minors and is not directed at any specific person.

10.4.2.Minors (persons under 18) may use the Community only with the consent and under the supervision of their legal representatives (parents or legal guardians), in accordance with applicable law. Legal representatives are solely responsible for the actions of minors, including the minor’s access to User Content and compliance with all applicable child protection, online safety, and content rating laws and regulations.

10.4.3.AMMA does not verify users’ ages and is not liable for any violations committed by minors or their legal representatives. If you are a legal representative (parent, guardian), you agree to monitor the minor’s use of the Community, take reasonable measures to protect the minor from content that may be inappropriate or harmful, and you release AMMA, its affiliates, directors, officers, employees, contractors, customers, and partners from any liability for any direct or indirect losses, damages, or other harm (including non-pecuniary or non-pecuniary loss), suffered by you or any third party arising out of or in connection with the minor’s use of the Community, to the maximum extent permitted by applicable law.

10.5.Disclaimer on “expert” status.

10.5.1.Users with “expert” status (hereinafter, “Experts”) independently position themselves as having professional knowledge and (or) experience in a certain field.

10.5.2.You confirm that you are aware that AMMA does not verify and does not guarantee that Experts have professional education, licenses, certificates, or experience. The “expert” status is assigned solely on the basis of the User’s own statement of having the relevant qualifications. Information about Experts, including their qualifications, specialization, and work experience, is for reference only; AMMA does not guarantee its accuracy.

10.5.3.The User und erstands and unconditionally agrees:

• that the “expert” status was assigned to the relevant users based on their own statement, and not as a result of verification by AMMA;

• that AMMA and Community administrators have no technical capability and are not obliged to verify the qualifications of persons presenting themselves as Experts;

• that Experts’ answers, recommendations and publications may contain errors, be incomplete, harmful, outdated or unsuitable for a particular situation;

• that Experts publish information and interact with you solely in their own name as private individuals, and not on behalf of AMMA;

• that the use of any Experts’ recommendations is solely at the User’s own risk.

10.5.4.The User fully waives any claims against AMMA, Community administrators, owners of the Mobile Application, affiliates, directors, officers, employees, contractors, customers, partners of AMMA for any losses, harm to health, non-pecuniary loss or other negative consequences that may arise as a result of using recommendations, advice or other information published by Experts.

10.6.Public nature of user content.

10.6.1.The Community does not provide private messages (direct) functionality. All User Content, including any uploaded files, is displayed publicly and is available for viewing by all Community users, including unregistered users. You undertake to exercise caution when publishing and refrain from disclosing Personal Data, including health data (such as test results), biometric data, intimate details, political views, religion, or other information that may cause harm or endanger you or third parties.

10.6.2.By using the Community, you acknowledge and confirm your consent that any personal data, including health data, intimate details, biographical details, personal stories or problems published by you in the Community, may be viewed, processed, distributed, or otherwise used by third parties without your consent. AMMA does not control such actions and is not liable for their consequences (including, among other things, commercial use, discrimination, harassment, or other risks).

10.6.3.By continuing to use the Community, you release AMMA, its affiliates, employees from any liability for actual damage, lost profit, non-pecuniary loss, or other negative consequences arising as a result of your public disclosure of any data in the Community or their use by third parties. This release does not apply to cases of intentional harm by AMMA.

10.6.4.Publication of Prohibited Content and unlawful use of other persons’ User Content are prohibited in the Community. You undertake to compensate AMMA for all losses caused by such violations.

10.7.Links to third-party websites and external content

10.7.1.The Community may contain links or provide access to third-party Internet resources and their content that is not checked or controlled by AMMA (“External Resources”).

10.7.2.AMMA is not liable for the availability, quality, legality, or compliance of External Resources, including their content, with applicable law.

10.7.3.By following links, you acknowledge and express consent that AMMA is not liable for any losses or harm from use of External Resources.

10.8.Disclaimer of liability for an item advertised in the Community

19.8.1.AMMA is not liable for any losses caused to the User by advertisers when responding to advertising placed in the Community. In such cases, all conflicts are resolved directly between the advertiser and the User. AMMA strongly requests that Users report such situations in order to prevent recurrence in future ad placements.

10.8.2.A link to any website, product, service, or any information of a commercial or non-commercial nature posted in the Community is not an approval or recommendation of such products (services, goods) by AMMA. AMMA is not liable for completeness and reliability of information in articles and advertisements placed in the Community.

11. AMENDMENT OF TERMS AND TERMINATION OF THE AGREEMENT

11.1.AMMA has the right to unilaterally amend the terms of the Agreement, and such amendments take effect from the moment a new version of the Agreement is published.

11.2.The User must review the current version of the Agreement each time before using the Community functions.

11.3.If the User does not agree with the terms of the new version of the Agreement, the User must cease using the Community.

12. TERM OF THE AGREEMENT

12.1.The Agreement enters into force from the moment of acceptance and remains in effect indefinitely until terminated by either Party.

12.2.The User has the right to terminate the agreement at any time by deleting the account and ceasing use of the Community. At the same time, permissions, consents and data provided by the User during the term of the Agreement (including for use of User Content and other similar) remain in effect after termination, unless otherwise agreed by the Parties and (or) provided by applicable law.

By continuing to use the Community after deleting the account, the User remains a party to the Agreement.

12.3.AMMA has the right to terminate the Agreement unilaterally out of court without applying liability measures or any other compensation by deleting the Community without any notice to the User.

12.4.Provisions on liability, limitation of liability and other provisions that continue to be effective by their legal nature remain effective until expiration of the limitation period for relevant claims.

13. FINAL PROVISIONS

13.1.Except where otherwise prohibited by law, this Agreement shall be governed in accordance with the laws of SAR Hong Kong (excluding its body of law governing conflicts of law), and any issues arising out of or in connection with using the Community and not regulated by the Agreement shall be settled in accordance with the legislation of SAR Hong Kong.

13.2.Except where otherwise prohibited by law, each of the parties submits to the exclusive jurisdiction of the courts of SAR Hong Kong to settle any disputes arising out of or in connection with this Agreement and/or using the Community, and that accordingly, proceedings must be brought in such courts. The parties irrevocably submit to the personal jurisdiction and venue of the courts of SAR Hong Kong and waive any defenses of improper venue or forum non conveniens.

13.3.Nothing in this Agreement shall deprive you of the protection afforded to consumers by the mandatory rules of law of the country in which you live.

13.4.You agree that  this Agreement, and any dispute between you and AMMA arising out of or in connection with this Agreement and/or using the Community shall be governed in all respects by the laws of SAR Hong Kong, without regard to choice of law provisions, and not by the 1980 UN Convention on Contracts for the International Sale of Goods.

13.5.Waiver of Class Action and Collective Relief. The parties agree that any claim, dispute, or controversy arising out of or relating to this Agreement and/or using the Community shall be resolved on an individual basis only. To the fullest extent permitted by applicable law, each party expressly waives any right to bring or participate in any class action, collective action, representative action, or similar proceeding in any court. No party may serve as a class representative or participate as a member of a class in any purported class, collective, or representative proceeding brought in court. The court may award relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that individual party’s claim. The court may not award relief for or against anyone who is not a party. The court may not consolidate more than one person’s claims. This waiver applies regardless of whether such actions are brought in a judicial forum or any other forum, except where such waiver is prohibited by law or deemed unenforceable by a court of competent jurisdiction.

13.6.If any provision of this Agreement is found invalid, this does not affect the validity or applicability of the remaining provisions of this Agreement.

13.7.This Agreement supplements any other agreements between you and AMMA, including our Privacy Policy and AMMA Community Guidelines.

13.8.Business Partners` co-registration. If you opt-in to Partner`s (e.g. Nestlé) co-registration* within the Community, you expressly consent to Partner`s processing and publishing your Personal Data from the Community (e.g. User-Generated Content (UGC), full name (first name and surname), date of UGC published) on Partner's official website(s) and related online platforms. For any questions or requests regarding this data processing (including access, rectification, deletion, or withdrawal of consent), please contact the Partner`s legal entity.

* Co-registration means placing Partner’s subscription box on the registration screen of the App where you are given an opportunity to sign up for Partner’s promotional program by way of submitting their registration data to the Partner according to Partner`s Privacy Policy.

14.1.Any appeals, suggestions, and claims of individuals and legal entities to AMMA related to the content and operation of the Community, infringement of rights and interests of third parties, requirements of the applicable law, as well as the requests of the authorized persons may be sent to the e-mail address: help@amma.family.

¡Bienvenida a la comunidad amma! Tenemos cuatro pilares importantes para mantener un ambiente acogedor para todas:

• Seguridad, no miedo.

• Apoyo y ayuda, no falta de respeto.

• Honestidad, no engaño.

• Amabilidad, no agresión.

¡Esperamos que sea claro! Pero si quieres un análisis detallado de estos conceptos, exploremos juntas.

Seguridad, no miedo

Queremos que nuestra comunidad sea un verdadero espacio seguro donde todas las participantes puedan sentirse cómodas y tranquilas al discutir los detalles más sensibles e íntimos de sus vidas, salud y fertilidad.

Usa el sentido común al publicar en los canales y protege la seguridad de otras participantes denunciando a usuarias y publicaciones que violen nuestras reglas.

• Denuncia a usuarias que acosen a otras, soliciten o de otra manera rompan las reglas.

• No desnudos, fotos sexualmente explícitas ni fotos de genitales. Se permiten fotografías de lactancia materna siempre que no tengan una connotación sexual.

• No ofertas sexuales.

• No ofertas de adopción privadas. Si te interesa adoptar, contacta con los servicios de adopción locales.

• No incites a otras a hacerse daño o cometer actos ilegales.

• No vendas, intercambies o dones medicamentos, con receta o sin ella.

• No publiques tus datos de contacto.

• No publiques información que no te pertenezca sin permiso. Esto incluye fotos de otras participantes y sus familias, sus historias personales, datos de contacto y propiedad intelectual.

• No siga consejos médicos sin consultar personalmente con su médico, especialmente si no están respaldados por referencias de fuentes confiables (OMS, ACOG, The Lancet, Cochrane Library, etc.).

• Está prohibido que las participantes organicen de forma independiente concursos, juegos de azar y otros juegos con premios materiales, sorteos, etc. Las encuestas con recompensas, juegos y otras actividades solo pueden ser iniciadas por nuestras administradoras dentro de la comunidad o en la aplicación amma pregnancy tracker a través de historias y banners en la página principal o en el Mercado. Hacemos esto para protegerte del fraude: en nuestros concursos, podemos ser responsables de nuestras acciones, pero no podemos controlar a otras.

Apoyo y ayuda, no falta de respeto

Nuestra comunidad es un lugar donde todas las madres y sus familias pueden hacer preguntas, compartir sus experiencias y dar y recibir consejos. Apoyáos unas a otras, responded a las preguntas de las demás, compartid vuestras experiencias únicas, pero recuerda siempre que tu experiencia es solo tuya y puede no ser siempre aplicable a las demás. Respeta todas las opiniones, perspectivas e historias de vida. Se cuidadosa y consciente de los sentimientos de las demás.

• Sigue al tema de cada canal: vuestras publicaciones deben corresponder al contenido del canal y a su tema.

• No spam. Por más urgente e importante que sea tu pregunta o historia, no la publiques en todos los canales: solo dejaremos una publicación y te daremos una advertencia.

• Evita generalizaciones: habla por tu misma y no hables por otras personas, incluso si crees que la mayoría actúa (o piensa) de cierta manera.

• Absolutamente no al trolling.

• Nuestra comunidad no es un lugar para promover negocios personales o publicidad comercial.

• No publiques imágenes o enlaces que contengan pornografía, material sexualmente explícito, contenido violento y/o otro contenido inapropiado y peligroso.

• Por favor, evita usar un tono condescendiente y expresiones potencialmente provocativas y vergonzosas al discutir temas sensibles.

• No referencies al aborto como asesinato.

• Se prohíbe incitar al aborto (persuadir de su necesidad). Se permite compartir experiencias personales sin presionar a los lectores.

• No avergüences a las demás ni culpes a las víctimas.

• No señales a otras usuarias o grupos en tus publicaciones, ni siquiera bajo el delgado pretexto de crear una discusión.

Honestidad, no engaño

Queremos que una atmósfera de confianza sea una característica distintiva de la comunidad amma. Aquí discutimos muchos temas sensibles, y es absolutamente importante para nosotras que todas se sientan seguras. Se honesta en tus publicaciones y comentarios.

• No tergiverses tu identidad o lugar de trabajo.

• Usa solo una cuenta.

• No uses experiencias personales, condiciones de salud física y/o mental, historias médicas, problemas psicológicos u otra información sensible para engañar, abusar, presionar o cualquier forma de ataque a las usuarias.

Amabilidad, no agresión

Queremos que esta comunidad se convierta en un lugar verdaderamente seguro para cada una de nuestras madres. Pero no podemos hacerlo sin ti. Se siempre respetuosa, incluso si no estás de acuerdo. Recuerda ser amable y educada.

• Los ataques personales, los insultos, las condenas, la intimidación y las discusiones públicas contra otras personas son absolutamente inaceptables. Esto incluye cualquier insulto directo o indirecto hacia usuarios individuales o grupos de personas.

Territorio inflamable (descripción del tema)

Planificar una familia, la salud reproductiva, el embarazo mismo, el parto y la crianza no siempre son perfectos y hermosos en realidad. En la comunidad amma siempre defendemos la creencia de que no hay una única norma para todas las mujeres en todo el mundo, y nos esforzamos por desmontar la imagen de la madre perfecta que nunca ha enfrentado dificultades.

Además, en la vida de cada madre, puede haber otros desafíos invisibles. La vida en el mundo moderno puede ser abrumadora, traumatizante, infuriante y angustiante. No queremos fingir que no hay problemas en tu mundo o que no existen. Por eso hemos creado un canal especial llamado "Territorio inflamable", donde puedes discutir temas sensibles que os preocupen, incluyendo política, religión, pérdidas y más.

Todo lo que pedimos aquí:

• Habla de temas dolorosos, conflictivos y potencialmente provocativos solo en este canal.

• Proporciona advertencias de contenido. Apoyamos la libertad de expresión, el deseo de discutir temas difíciles y la aspiración de ser vistas y escuchadas, pero alguien puede no estar preparada para estos temas y su discusión. Al dar a algunas usuarias el derecho de hablar sobre cualquier tema, también damos a otras el derecho de no participar.

• Entendemos lo importante que es desahogarse, así que la moderación en este canal será menos estricta. No obstante, te pedimos que te adhieras a nuestras reglas básicas: no ofendas a otras, incluso si no estás de acuerdo con ellas, no amenaces, acuses ni avergüences.

Unos puntos más importantes a recordar:

Ten en cuenta que podemos dar hasta 3 advertencias, suspender, imponer un modo "solo lectura" o prohibir a usuarias activas que no sigan las reglas de la comunidad. A las usuarias que violen repetidamente las reglas se les puede pedir que abandonen la comunidad.

Las publicaciones que denigren las reglas y/o la aplicación de las mismas por parte de las moderadoras serán eliminadas sin previo aviso. Alentamos a las usuarias a proporcionar comentarios de manera constructiva y respetuosa a través del sistema de informes de la aplicación o por correo electrónico en help@amma.family. Crear una nueva cuenta después de una suspensión resultará en una prohibición permanente. Abstente de publicar o comunicarte con nuestra comunidad en nombre de usuarias prohibidas. Fueron prohibidas por una razón, y hacerlo puede llevar a tu suspensión.

Cualquier publicación que no cumpla con los criterios de una moderadora puede ser eliminada sin aviso.

La comunidad amma es principalmente un espacio para que las mujeres tengan un lugar seguro y de apoyo para discutir su salud y experiencias. Sin embargo, tod@s l@s person@s son bienvenid@s en la comunidad siempre que sigan nuestras reglas.
