Amma Subscription and Money-back Policy

AMMA FAMILY US INC., with a registered address at 16192 Coastal Highway, City of Lewes, County of Sussex, State of Delaware, 19958, USA, EIN 37-2158945,
and other amma affiliates, operating together under the brand "amma" (hereinafter collectively referred to as “amma”, or “we”),
and the person using the Application (hereinafter – “the User”), on the other hand,
hereinafter jointly referred to as “the Parties”, and individually – “the Party”,
have entered into the agreement regarding these Amma Subscription and Money-back Policy in relation to the mobile applications “amma Pregnancy Tracker” published in online stores (hereinafter – “the Application”) as follows (hereinafter – “the Agreement”).
  1. Premium subscription. The Application offers the Premium subscription that grants you access to additional features like:
• disabling Advertising in the Application;
• the ability to choose a unique avatar from those offered to choose from in the Application;
• additional interactive features (for example, additional opportunities to compare the baby: with flowers and with desserts);
• extended access to the content of the Application;
• other additional functions at the discretion of amma.
  1. Trial period. Some of our subscriptions include a trial period, where you can experience the Application for a specified period at no cost or at less cost than usual (“Trial”). Subscription with the Trial period will automatically renew to a paid (full price) subscription once your Trial expires.
  2. Price and tax changes. If Amma offers you a Premium subscription at a special price for a certain period and you agree, you irrevocably agree that upon expiration of such period, the price for a Premium subscription will be full, and you agree to pay the full price for subsequent periods unless you have unsubscribed as stated below.
Amma may from time to time make changes to Premium subscription, including recurring subscription fees, and will communicate any price changes to you in advance. Price changes will take effect at the start of the next subscription period following the date of the price change and, by continuing to use the Premium subscription after the price change takes effect, you will have accepted the new price. If you don’t agree to a price change, you can reject the change by unsubscribing from the applicable Premium subscription prior to the price change going into effect.
  1. Renewal and cancellation. Premium subscription purchased by You will automatically renew at the end of the applicable subscription period, unless you cancel your Premium subscription before the end of the then-current subscription period as stated below.
If you have purchased a Premium subscription or Trial through the website: you can cancel your Premium subscription before it renews to avoid the billing of the fees for the next Subscription period by writing your request to unsubscribe to help@amma.family not later than 5 calendar days before the renewal date (and for the Trial period: not later than 3 calendars days before the expiration of the Trial).
The subscription is terminated upon the expiration of the paid subscription period.
  1. Money-back (refund) policy.
Money-back (refund) policy in relation to writing-off money for the Premium subscription for the first time after the Trial expires: you can request a refund only during 30 calendar days after start of the Trial by sending the request to help@amma.family. Upon receiving your request, we check whether you have had at least 3 consecutive sessions in the App before refund request and, if so, we make the refund not later than 21 calendar days after receiving your request.
Money-back (refund) policy in relation to re-writing-off money for the Premium subscription for the second and so on time after the Trial expires. The fees you have paid are non-refundable and/or non-exchangeable, unless otherwise is stated herein or as required by applicable law. In addition, certain refund requests may be considered by amma on a case-by-case basis and granted at our sole discretion. A refund can be requested only during 14 calendar days after writing-off money for the subscription period for which the refund is requested by sending the request to help@amma.family. We reserve the indefeasible right to refuse the refund at our sole discretion.
Note for residents of certain US states. If you reside in California or Connecticut and cancel the purchase at any time prior to midnight of the 3rd business day after the date of such purchase, we will return the payment you have made.
Note for the EU residents: If you are a consumer based in the EEA or Switzerland, you have an automatic legal right to withdraw from the contract for purchase of our services. However, when you make a purchase of a single item of digital content (such as a video recording or a pdf file) you expressly agree that such content is made available to you immediately and you, therefore, lose your right of withdrawal and will not be eligible for a refund. By signing up for our service which is not a single item of digital content and is provided on a continuous basis (such as subscriptions to the Application) you expressly request and consent to an immediate supply of such service. Therefore, if you exercise your right of withdrawal we will deduct from your refund an amount that is in proportion to the service provided before you communicated to us your withdrawal from the contract for purchase.
Exercise of the Right of Withdrawal. Where you have not lost your right of withdrawal, the withdrawal period will expire 14 days after the day you enter into the contract for purchase. To exercise your right of withdrawal, you must inform us at our email help@amma.family of your decision to withdraw from the contract for purchase by an unequivocal statement. To meet the withdrawal deadline, you need to send your communication to us saying you wish to withdraw from the contract for purchase before the withdrawal period has expired.
  1. Except where otherwise prohibited by law, this Agreement shall be governed in accordance with the laws of the State of Delaware (excluding its body of law governing conflicts of law), and any issues arising out of or in connection with the Agreement shall be settled in accordance with the legislation of the State of Delaware.
Except where otherwise prohibited by law, each of the parties submits to the exclusive jurisdiction of the courts of the State of Delaware to settle any disputes arising out of or in connection with this Agreement, and that accordingly, proceedings must be brought in such courts. The parties irrevocably submit to the personal jurisdiction and venue of the courts of the State of Delaware and waive any defenses of improper venue or forum non conveniens.
Nothing in this Agreement shall deprive you of the protection afforded to consumers by the mandatory rules of law of the country in which you live.
You agree that this Agreement, and any dispute between you and amma shall be governed in all respects by the laws of the State of Delaware, without regard to choice of law provisions, and not by the 1980 UN Convention on Contracts for the International Sale of Goods.
  1. Waiver of Class Action and Collective Relief. The parties agree that any claim, dispute, or controversy arising out of or relating to this Agreement and/or using the Applications shall be resolved on an individual basis only. To the fullest extent permitted by applicable law, each party expressly waives any right to bring or participate in any class action, collective action, representative action, or similar proceeding in any court. No party may serve as a class representative or participate as a member of a class in any purported class, collective, or representative proceeding brought in court. The court may award relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that individual party’s claim. The court may not award relief for or against anyone who is not a party. The court may not consolidate more than one person’s claims. This waiver applies regardless of whether such actions are brought in a judicial forum or any other forum, except where such waiver is prohibited by law or deemed unenforceable by a court of competent jurisdiction.
  2. This Agreement shall enter into force from the moment purchasing the subscription.
  3. If any provision of this Agreement is held invalid, it shall not affect the validity or enforceability of the remaining provisions of this Agreement.
